Meet Elvin E. Smith III

Elvin is registered to practice before the United States Patent and Trademark Office and brings more than 30 years of high-profile trial, appellate, and IPR experience to the Willowbend ADR Group.

Elvin Smith has represented clients (from individuals to Fortune 50 companies) on both sides of the legal bar in high-exposure and high-profile disputes in federal and state trial and appellate courts and before the Patent Trial and Appeal Board in a broad range of cases.

Professional Biography

Elvin represented clients in several cases involving intellectual property (telecommunications, software, sports and rehabilitation equipment, wired and wireless applications, GPS tracking, portable storm shelters, internet search, automotive and trucking, entertainment, etc.); product liability (major automotive manufacturers, trucking manufacturers, lighting retailers, etc.); the False Claims Act; commercial litigation (theft of trade secrets, non-compete or solicitation, theft of corporate opportunity, breach of contract, DTPA, fraud, etc.); and other general litigation matters.

Since 2002, Martindale-Hubbel® has given Elvin an AV rating. He is a member of the Federal Circuit, Fifth Circuit, and Eastern District of Texas Bar Associations (where he has served on the Bench/Bar Planning Committee). He is the Parliamentarian of the Paul Brown Inn of Court and Vice President of the Grayson County Bar Association.

Elvin attended Texas A&M University from 1983–1989. While at A&M, Elvin was the team captain of A&M’s 1985 National Championship Trap & Skeet Team. He also competed in the 1984 Olympic Trials for Skeet Shooting. Elvin received a B.S. in Chemical Engineering and an MBA (with a concentration in finance and accounting) from Texas A&M.

Upon graduation from A&M, Elvin enrolled in the Juris Doctor program at the University of Texas.  While in law school, Elvin was a finalist in UT’s Senior Honors Moot Court and Mock Trial competitions. He also completed an internship with Chief Justice Tom Phillips of the Texas Supreme Court. Elvin graduated from UT Law in 1992.

After law school, Elvin completed a two-year judicial clerkship with Judge Paul Brown in the Eastern District of Texas (1992–1994). After his clerkship, Elvin practiced law in the products liability section of Strasburger & Price, where he was elevated to equity partner in 2001. Also in 2001, Elvin obtained his registration as a patent attorney with the United States Patent and Trademark Office. Elvin continued at Strasburger until the fall of 2003.

From 2003 to 2006, Elvin practiced law at Juneau & Boll, where he had a mix of plaintiff and defense cases involving personal injury, product liability, and intellectual property matters. From 2006 to 2021, Elvin practiced law at the Law Office of Elvin E. Smith, III, where he primarily handled intellectual property, commercial litigation, and product liability matters for both plaintiffs and defendants. During this time period, Elvin also served as the Chief Operating Officer for Advanced Search Labs, a DFW-based start-up in the internet search space. And, from 2021 to present, Elvin is the partner-in-charge of the Sherman Office of Siebman Law, where he primarily handles intellectual property, commercial litigation, the False Claims Act, and product liability matters for both plaintiffs and defendants.

In addition to being registered to practice before the United States Patent and Trademark Office (2021), Elvin is licensed to practice in the State of Texas (1992) and admitted to the Eastern, Northern, Southern, and Western Districts of Texas, the Federal Circuit Court of Appeals, and the Fifth Circuit Court of Appeals.

Elvin is married to fellow Judge Brown law clerk (1997–99) Rebecca Smith, and they have one son, Elvin IV, who is in elementary school and plays virtually every sport offered. Elvin III serves as the Bear Den Leader for Pack 84 of the Boy Scouts of America and is also the Pinewood Derby Chair for 2022-2023 and 2023-2024.
